  New Christian music FM radio station

1.

The Commission approves the application for a broadcasting licence for a low-power English-language specialty FM radio programming undertaking at Fredericton. As proposed, the station will operate on the frequency 96.5 MHz, channel 243LP, with an effective radiated power of 23 watts.

Subject to the requirements of this decision, the Commission will issue a licence expiring 31 August 2007.
  The proposed service

The new station will operate 126 hours each week. While the station will predominantly offer Christian music, it will also broadcast 20% spoken word programming including daily inspirational messages, surveillance material (news, weather, sports, traffic), interviews with community and church leaders, as well as open-line programming on community issues. When open-line programs are broadcast, the applicant undertook to utilize an audio delay system.

At least 80% of the station's total weekly music will be drawn from subcategory 35 (non-classic religious). A condition of licence in this regard is set out later in this decision. The remaining 20% would come from the other subcategories of category 3 as well as subcategory 21 (pop, rock and dance) and subcategory 22 (country and country-oriented) of category 2.

The applicant indicated that while it proposed a predominately Christian music service it would offer some religious programming. The Commission reminds the applicant that it must abide by the requirements for balance in religious programming as set out in the Commission’s religious broadcasting policy (Public Notice CRTC 1993-78). The Commission further reminds the licensee of the policy regarding solicitation of funds specified in that public notice.

In the area of Canadian talent development, the Commission notes the applicant’s commitment to allocate $500 annually. Joy FM will sponsor at least one concert per year and provide remote broadcasts of local concerts and festivals. It will also broadcast interviews with and promote Canadian artists. The applicant indicated that it would increase the level of its contribution incrementally to $900 in the final year of the licence term.
  Conditions of licence

The licence will be subject to the conditions specified in the licence to be issued. Further, as conditions of licence, the licensee must:
 
  • operate the station within the Specialty format as defined in Public Notice CRTC 1995-60, as amended from time to time.
 
  • draw at least 80% of the total weekly music from sub-category 35 (non-classic religious).
 
  • maintain a local weekly programming level of at least 42 hours in order to accept or solicit local advertising.
 
  • broadcast, in any broadcast week, less than 50% hit material as defined in Public Notice CRTC 1997-42, as amended from time to time.
 
  • contribute annually a minimum of $500 for the development and promotion of Canadian talent.
 
  • adhere to the guidelines on gender portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-role portrayal code for television and radio programming, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council.
 
  • adhere to the provisions of the CAB's Broadcast code for advertising to children, as amended from time to time and approved by the Commission.
  Other matters

The technical parameters approved in this decision are for a low-power unprotected FM service. Accordingly, the applicant would have to select another frequency for the operation of the service should optimum utilization of the broadcasting spectrum so require.

The licence will only be issued and effective when the new station is ready to begin operation. When the licensee has completed construction and is prepared to commence operation, it must advise the Commission in writing. If the station is not constructed and ready to operate within 12 months of today’s date, extensions to this time frame may be granted provided that the licensee applies in writing to the Commission before the 12-month period or any extension of that period expires.

The Department of Industry has advised the Commission that this application is conditionally technically acceptable. The Department will only issue a broadcasting certificate once it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

In accordance with section 22(1) of the Broadcasting Act, the Commission will only issue the licence and grant the authority to operate when it receives notification from the Department of Industry that its technical requirements have been met, and that a broadcasting certificate will be issued.

12.

In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an employment equity policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
