New low-power FM radio programming undertaking

1.

The Commission approves the application for a broadcasting licence for a low-power English-language FM radio programming undertaking at Burnaby (Broadway/Lougheed Highway). The station will operate on the frequency 88.1 MHz, channel 201LP, with an effective radiated power of 50 watts.

Subject to the requirements of this decision, the Commission will issue a licence expiring 31 December 2001.

The Department of Industry has advised that the undertaking will have the above-noted technical parameters rather than those indicated in Notice of Public Hearing CRTC 2000-6 dated 11 July 2000.

The applicant proposes to provide information related to the construction of the Broadway/ Lougheed Corridor to accelerate public understanding of the construction procedures and emphasize safety concerns. It is expected that construction will be completed by the end of 2001.

The Commission has considered the circumstances of this application and is of the view that it is appropriate to apply the licensing policy for low-power radio broadcasting undertakings set out in Public Notice CRTC 1993-95 dated 28 June 1993.

Conditions of licence

The licence will be subject to the conditions specified in the licence to be issued. Further, as conditions of licence, the licensee must:

  • use the station solely to broadcast information explaining construction procedures in detail, safety policies, temporary traffic routes and parking restrictions and to respond to inquiries generated by the public;
  • not broadcast any advertising material; and
  • not broadcast any musical selections.

The technical parameters approved in this decision are for a low-power unprotected FM service. Accordingly, the applicant would have to select another frequency for the operation of the service should optimum utilization of the broadcasting spectrum so require.

The Department of Industry has advised the Commission that this application is conditionally technically acceptable. The Department will only issue a broadcasting certificate once it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

9.

In accordance with section 22(1) of the Broadcasting Act, the Commission will only issue the licence and grant the authority to operate when it receives notification fromthe Department of Industry that its technical requirements have been met and that a broadcasting certificate will be issued.
