New cable distribution undertaking

 

1.

The Commission approves the application by the City of Dawson for a licence to carry on a cable distribution undertaking to serve Dawson City.

 

2.

The applicant falls within the definition of a municipal government as set out in section 2 of the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences) (the Direction) and in the Order amending this Direction (P.C. 1998-1268). The Commission is satisfied that all of the criteria set out in section 4 of the Direction have been met and, accordingly, will issue a licence expiring 31 August 2006. The licence will be subject to the conditions specified in this decision and in the licence to be issued.

The Commission notes that this cable system will replace the City of Dawson’s existing radiocommunication distribution undertaking whose licence expires 31 August 2000. The applicant has indicated that it would surrender the licence for that undertaking, if the current application were approved.

 

4.

The operation of this undertaking will be regulated pursuant to Parts 1 and 3 of the Broadcasting Distribution Regulations and the licence will be subject to the conditions specified in this decision and in the licence to be issued.

 

5.

The licensee may receive any authorized signals over the air, or from any licensed or exempted Canadian broadcasting distribution undertaking authorized to provide signals to other broadcasting distribution undertakings.

 

6.

Although the Commission does not regulate the rates of Class 3 undertakings, it notes that the applicant has proposed a monthly subscriber fee of $29.95.

 

7.

It is a condition of licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters’ Voluntary Code Regarding Violence in Television Programming, as amended from time to time and approved by the Commission.

 

8.

The licence will only be issued and effective when the undertaking is ready to begin operation. When the licensee has completed construction and is prepared to commence operation, it must advise the Commission in writing. If the undertaking is not constructed and ready to operate within 12 months of today’s date, extensions to this time frame may be granted provided that the licensee applies in writing to the Commission before the 12-month period or any extension of that period expires.
