Public Notice CRTC 1999-121

The Commission has received the following application:

ONTARIO REGION

1.  OTTAWA EAST, OTTAWA WEST AND CARP, Ontario

Application (199908357) by ROGERS OTTAWA LIMITED/LIMITÉE (ROGERS) to temporarily amend the broadcasting licences for the cable distribution undertakings serving the above-noted localities during the Jerry Lewis Labour Day Telethon. The telethon is scheduled to air for a 22-hour period, from 9:00 p.m. on 5 September 1999 to 7:00 p.m. on 6 September 1999.

The requested amendment would allow Rogers to interrupt the carriage of the telethon on WHEC Rochester, New York, in order to broadcast locally-produced segments.

A condition of licence would be required to relieve Rogers from the requirement of subsection 7(a) of the Broadcasting Distribution Regulations which states in part that: "A licensee shall not alter or delete a programming service in the course of its distribution except (a) as authorized under a condition of its licence..."

Rogers also requests authority to distribute the signal of WHEC, with the locally-produced segments, on its community channel, for the duration of the telethon. Approval of this request would require a condition of licence.

In the event that the application is brought to the oral phase of the hearing it would be helpful to the Commission if you provide reasons why your written comments are not sufficient and an appearance is necessary;
