Telecom Order CRTC 99-685

 

On 26 May 1999, GT Group Telecom Inc. (Group Telecom) filed an application under Tariff Notice (TN) 7, amended by TN 7A dated 16 June 1999, for approval of proposed revisions to its General Tariff (CRTC 21190) to introduce tariff rates for Ontario, Quebec and Alberta.

1.Group Telecom has not provided terms and conditions and rates relating to the collection of contribution in association with circuits provided on a line-side basis.

 

2.The Commission considers that Group Telecom would not be able to prevent interexchange carriers from using line-side access.

 

3.Accordingly, the Commission considers that it is necessary for Group Telecom's General Tariff to include terms and conditions with respect to the collection of contribution charges for interconnection on a line-side basis.

 

4.The Commission is of the view that provisions for line-side access in the Access Services Tariff for Interconnection with Wireless Service Providers are also required.

 

5.In light of the foregoing:

 

A) The Commission approves the revisions proposed under TN 7 and 7A on an interim basis, with the following amendments:

 

i) add terms in Item 202.3 to provide for the collection of contribution on line-side access on a per-minute basis, and when a mechanism for measurement of traffic to determine contribution on a per-minute basis is not available;

 

ii) in Item 202.3 e), with respect to Contribution Exemptions, add the following term under sub-paragraph 1:

 

"The contribution charges specified in Item 202.3 do not apply when an interconnecting circuit associated with line-side access is used to provide a dedicated voice service, dedicated data service or a local service or is associated with a stand-alone administrative location or system which is not directly connected to the IXC's interexchange network, provided that the IXC applies to the Commission on a case-by-case basis and provides evidence satisfactory to the Commission that by reasons of technical, economic or operational characteristics of the service, it is unlikely that the connections will be used significantly for joint-use interexchange services."; and

 

renumber the remaining terms accordingly;

 

iii) amend the terms in Item 301.4 d) to include provisions for interconnection on a line-side basis and add the following rates associated with line-side access in Ontario and Quebec:

 

Access Channels, each
1 to 12 channels $3.10
13 to 24 channels $5.60
25 to 36 channels $6.55
37 to 48 channels $7.10
49 to 60 channels $7.45
61 to 72 channels $7.70
73 to 84 channels $7.90
85 to 96 channels $7.90
over 96 channels $8.05; and

 

iv) in Item 301.4, with respect to the provision of trunk-side access in the operating territory of Ontario and Quebec, add provisions for Interconnection Trunk Termination, per DS-1, at a rate of $137.10 per month.

 

B) Group Telecom is directed to issue revised tariff pages within 10 days of the date of this Order incorporating the changes set out above.
