Telecom Order CRTC 99-63

 

By letter dated 16 November 1998, Communication Sergau Inc. (Communication Sergau) registered as a reseller with the Commission. Attached to the submission was an affidavit dated 16 November 1998 which sought a contribution exemption with respect to Centrex systems used to provide single-hop or local services.

1.By letter dated 16 December 1998, Bell Canada (Bell) stated that it had reviewed the affidavit and noted that it generally appears to satisfy the evidentiary requirements for such exemptions with one exception. Bell stated that there is no reference in the affidavit to specific Centrex services which might already be in place. Rather, Bell stated that the affidavit makes a generic reference to systems in several areas of Bell's territory.

 

2.In this respect, Bell stated that it has reviewed its files and can find no record of Centrex services ordered or in place for Communication Sergau. In light of this, Bell submitted that the application of Communication Sergau should be treated as a request for advance approval of an exemption, pending the installation of service.

 

3.Accordingly, Bell agreed with a request for advance approval of an exemption, subject to the requirement that Communication Sergau provides a revised affidavit within 30 days after the installation of its first system(s), identifying the Centrex system(s) and affirming that it is arranged in a manner to limit Communication Sergau's services to local or single-hop configurations.

 

4.The Commission is of the view that Communication Sergau has provided an affidavit which satisfies the evidentiary requirements for advance approval for Centrex single-hop circuits.

 

5.In light of the foregoing, Communication Sergau's application is granted advance approval effective the date of installation, subject to the requirement that Communication Sergau provides a revised affidavit within 30 days after the installation of its first system(s), identifying the Centrex system(s) and affirming that it is arranged in a manner to limit Communication Sergau's services to local or single-hop configurations.
