Telecom Order CRTC 99-377

 

On 26 March 1999, The Corporation of the City of Thunder Bay - Telephone Division filed an application for approval of tariff revisions to the General Tariff, to introduce a Spring Features Promotion, allowing all business and residence customers currently equipped with Touch-Tone service to subscribe free for one month with no service connection charge to a Vista 350 telephone set and/or any one grouped Custom Calling Feature(s) or Voice Mail Feature(s).

1.In an application dated 11 March 1999, O.N. Tel filed, for Commission approval, pursuant to section 29 of the Telecommunications Act, an interconnection agreement with AT&T Canada Corp.

 

2.The interconnection agreement is for purposes of interexchange services, including point-to-point synchronous digital data, point-to-point analogue data, multi-point analogue data, DS-1 customer interface, fractional T1, point-to point asynchronous data and terminating message toll.

 

3.O.N. Tel revised its application on 30 March 1999.

 

4.The Commission notes that, pursuant to the revised application, the settlement on terminating message toll traffic provides for the payment by AT&T Canada Corp. of a terminating voice minute rate which will be in effect until the Commission approves a switching and aggregation rate for O.N. Tel. In addition, AT&T Canada Corp. will pay the applicable local exchange carrier's Carrier Access Tariff (CAT) rate.

 

5.The Commission notes that O.N. Tel, unlike the other local exchange carriers in its toll operating territory, does not have an approved CAT rate in place for its own local exchanges.

 

6.The Commission is of the view that the interconnection agreement should reflect the settlement for message toll traffic terminating in O.N. Tel's own local exchanges until its own CAT rate is approved.

 

7.In light of the foregoing, the Commission orders that:

 

1) The proposed agreement is approved on an interim basis.

 

2) O.N. Tel is to file a revised agreement that reflects the basis for settlement for message toll traffic terminating in O.N. Tel's local exchanges until O.N. Tel's own CAT is approved.
