BC TEL proposed tariff revisions under Tariff Notice (TN) 3880 dated 19 November 1998, for a promotional offer called "Winback Service Charge Waiver". The promotion is designed to increase the sale of business multi-lines, Information System Access lines, and individual business lines. |

1.The company submitted that the eligible customers for this promotion are those who are obtaining service from an alternate provider of local services prior to enrolment in the proposed promotion. Those customers can register for the promotion by responding to a marketing contact from the company. |

2.The Commission notes that in a letter dated 16 April 1998 re: Commission Decision Regarding CRTC Interconnection Steering Committee Dispute on Competitive Winback Guidelines, it directed that an Incumbent Local Exchange Carrier (ILEC) cannot attempt to win back a customer for a period of three months after that customer's service has been completely transferred to another local service provider. The only exceptions are those customers who have advised the ILEC that they intend to change local service provider. |

3.The Commission also notes that in TN 3880, BC TEL is not clear as to whether it plans to contact only those customers who have been with competitors for three months or more, consistent with the Commission's 16 April 1998 letter. |

4.In light of the above, BC TEL TN 3880 is denied. |
