Telecom Order CRTC 99-320

 

By letter dated 17 November 1998, Quartet Service Corporation (Quartet) applied for contribution exemption with respect to facilities used exclusively to provide local services, or long distance services via long distance service providers through equal access. Quartet submitted that its applications should be granted given that contribution has already been paid with respect to these services. Quartet provided an affidavit dated 17 November 1998.

1.By letter dated 4 December 1998, Bell Canada (Bell) submitted that the evidence was deficient: (a) there was no reference as to whether the exemption was requested with respect to any facilities provided by Bell; if so, even though Quartet has registered as a reseller with the Commission, it is required to also register with Bell pursuant to its tariffs; and (b) if the exemption request applied to services provided by Bell, a clear reference to the services is required to identify which ones are the subject of the exemption request; a list of billing telephone numbers included in the affidavit would be useful for this purpose.

 

2.By letters dated 18 and 21 December 1998, Quartet provided a draft-revised affidavit and a final revised affidavit, respectively.

 

3.By letter dated 11 February 1999, Quartet provided a revised affidavit and a

 

4.confidential diagram in response to the Commission's staff letter of 4 February 1999.

 

5.By letter dated 19 February 1999, Bell agreed with the exemption.

 

6.The Commission finds that Quartet's latest affidavit meets the relevant evidentiary requirements.

 

7.In light of the foregoing, Quartet's application is approved effective the date of installation such that no contribution is payable.
