Telecom Order CRTC 99-1196

  On 7 September 1999, Maskatel inc. (Maskatel) filed an application for approval of an Interim Transiting Agreement with Télébec ltée (Télébec).

  1. With its application, Maskatel included a copy of a letter that it received from Télébec, outlining Télébec's objections to a particular clause in the agreement specifying that the two parties would exchange traffic without compensation.
  2. In that letter, Télébec also noted that it intended to file a tariff that would compensate it for providing traffic termination to Maskatel. Télébec concluded that it would be unable to sign a transiting agreement such as that proposed by Maskatel prior to approval of the applicable tariffs.
  3. The Commission notes that no comments were filed with respect to Maskatel's application.
  4. The Commission also notes that it is in the process of examining Télébec's proposed transiting tariff.
  5. The Commission further notes that Télébec terminates traffic from incumbent local exchange carriers (ILECs) which operate within the same local calling area, such as Bell Canada, without charge.
  6. The Commission considers that, on an interim basis, it is in the public interest for Télébec to terminate local traffic from Maskatel on the same basis as it terminates local traffic from ILECs, that is without charge.
  7. In light of the foregoing, the Commission gives interim approval to the agreement and directs Télébec, on an interim basis, to terminate local traffic from Maskatel without charge.
