On 30 June 1999, BC TEL [now TELUS Communications (B.C.) Inc.] filed Tariff Notice (TN) 3964 proposing to extend the enrolment period for the One Free Month Local Winback Promotion. This application was given Commission approval in Telecom Order CRTC 99-709 dated 26 July 1999. Comments were received on 30 July 1999 from Call-Net Enterprises Inc. (Call-Net).

1. The Commission has examined the application on a de novo basis in light of the comments received from Call-Net.

 

2. The One Free Month Local Winback Promotion was approved in Telecom Order CRTC 99-60 dated 21 January 1999. Customers enrolled in the promotion receive a credit on their seventh month's bill equal to the average of their second to sixth months' bills for their multi-line, Information System Access, or individual business lines. The original enrolment period ran from 28 January to 28 July 1999. TN 3964 proposed to extend the enrolment period to 27 January 2000.

 

3. Call-Net submitted that the discounted subscription period (or discounted monthly rate period) for the promotion should be viewed as seven months because the credit received on the seventh month is contingent on the customer subscribing to the promotion for the previous six months. Call-Net further submitted that the promotion, as extended, would not be a promotion of limited duration because the combined enrolment period and discounted subscription period would be nineteen months.

 

4. The Commission is of the view that the discounted monthly rate period of the promotion is one month. Under TN 3964, the combined enrolment period and discounted monthly rate period would be thirteen months.

 

5. The Commission is of the view that the combined enrolment period and discounted monthly rate period of a promotion should not exceed twelve months.

 

6. In light of the above, the Commission considers that the enrolment period of the promotion should not extend beyond 27 December 1999. Subject to this change, the Commission approves TN 3964 on a de novo basis.
