Acquisition of assets | |
1. The Commission approves the applications by Fraser Valley Broadcasters Ltd. (Fraser Valley) on behalf of a newly-incorporated corporation, Fraser Newco, for authority to acquire as part of an inter-corporate reorganization, the broadcasting assets of Fraser Valley (licensee of CKMA Abbotsford, CHWK Chilliwack, CKGO Hope and its transmitter CKGO-FM-1 Boston Bar) and Star-FM Radio Inc. (Star-FM) (licensee of CKSR-FM Chilliwack and its transmitters CFSR-FM and CFSR-FM-1 Abbotsford), and for broadcasting licences to continue the operation of these undertakings. | |
2. The Commission notes that, in advance of this transaction, Fraser Valley and Star-FM amalgamated to form Fraser Valley Broadcasters Amalco (FVB Amalco). As a result of the amalgamation, FVB Amalco was the holder of all the broadcasting assets previously owned by Fraser Valley and Star-FM. As a final step, FVB Amalco will transfer the business operations, staff and assets of FVB Amalco to Fraser Newco, a wholly-owned subsidiary of FVB Amalco. | |
3. The Commission will issue licences to Fraser Newco, expiring 31 July 2006, upon surrender of the current licences. The licences will be subject to conditions specified in this decision and in the licences to be issued. | |
4. With respect to CKSR-FM and its transmitters CFSR-FM and CFSR-FM-1, the Commission notes that, pursuant to section 2.2(6) of the Radio Regulations, 1986, (the regulations) as amended, an FM licensee may, in a broadcast week, reduce the percentage of its Canadian musical selections from content category 2 referred to in section (7), (8) or (9) to: | |

5. With respect to CKMA, CHWK and CKGO, by condition of each licence, the licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the regulations, in any broadcast week where at least 90% of musical selections from content category 2 that it broadcasts are selections released before 1 January 1981: | |

6. For purposes of this condition the terms "broadcast week", "content category" and "musical selection" shall have the meaning set out in section 2 of the regulations. | |
7. The Commission reminds the licensee that it must specify, on music lists provided to the Commission, the year of release for all musical selections broadcast. | |
8. In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an Employment Equity Policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources. | |
9. In view of the approval granted herein, it would appear that no further action is required on the licence renewal applications 199812318 submitted by Star-FM Radio Inc. and 199812326, 199812342 and 199812344 submitted by Fraser Valley Broadcasters Ltd. announced in Public Notice CRTC 1999-100 dated 21 June 1999. | |
