New television programming undertaking

Summary

CTV network programming received in Huntsville will now originate in North Bay, instead of being delivered from Kitchener via a transmitter at Wiarton.

1.  The Commission approves the application for a broadcasting licence for an English-language television programming undertaking at Huntsville, using the currently approved facilities of CKCO-TV-4 Huntsville, a transmitter of CKCO-TV-2 Wiarton, which currently delivers CTV programming to Huntsville.

2.  Subject to the requirements of this decision, the Commission will issue a licence expiring 31 August 2002. This licence will be subject to the conditions specified in this decision and in the licence to be issued.

3.  The licence term granted herein, while less than the maximum of seven years permitted under the Broadcasting Act, will enable the Commission to consider the licence renewal of this undertaking at the same time as that of CKNY-TV North Bay.

4.  As a result of this approval, CTV network television programming will be received in Huntsville via the North Bay affiliate, rather than from Kitchener. The licensee argued that the Huntsville residents would find the locally-originated programming from North Bay to be more relevant than that currently delivered from Kitchener. While the majority of the programming will originate with CKNY-TV North Bay, the Commission notes that this undertaking will broadcast approximately one and a half hours per week of separate, original programming directed to Huntsville.

5.  In a related decision published today (Decision CRTC 99-163), the Commission has approved an application to add a transmitter of CKCO-TV Kitchener at Wiarton, to deliver CTV service to that community.

6.  As conditions of licence, the licensee must:

·  operate this broadcasting undertaking as part of the network operated by CTV Television Network Ltd.

·  broadcast no more than 6.5% of the commercial availabilities on this station separately from those broadcast on CKNY-TV North Bay, for each hour of original, station-produced programming broadcast exclusively on the Huntsville station each week.

·  adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' (CAB) Voluntary Code Regarding Violence in Television Programming, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council (CBSC).

·  adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission, and

·  adhere to the guidelines on gender portrayal set out in the CAB's Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the CBSC.

7.  The Commission acknowledges and has considered all of the interventions submitted with respect to this application.
