MTS COMMUNICATIONS INC. - MECHANISM TO RECOVER FUTURE INCOME TAX EXPENSE: ADDITION OF WINNIPEG PUBLIC CONSULTATION TO THE PROCEDURES IN TELECOM PUBLIC NOTICE CRTC 98-12

  1. In MTS Communications -  Mechanism to Recover Future Income Tax, Telecom Public Notice CRTC 98-12, 29 May 1998 (PN 98-12), the Commission initiated a proceeding to examine the appropriateness and timing of an exogenous factor adjustment which MTS Communications Inc. (MTS) proposed to incorporate into its Price Cap Index. The exogenous factor adjustment is intended to provide for the gradual recovery of future income tax expenses.
  2. The Commission has received numerous comments on MTS' proposal from interested individuals and groups throughout Manitoba. Several of the comments have included requests for an oral hearing in Manitoba to permit interested parties to present their views on MTS' proposal to the Commission.
  3. Having considered these requests, the Commission is persuaded that an oral consultation in Manitoba would be appropriate in this case. Accordingly, to ensure that the views of all interested parties are explored to the fullest extent possible, the Commission will hold a public consultation at the Delta Winnipeg Hotel, 288 Portage Avenue, commencing at 9:00 a.m. on Saturday, 7 November 1998. Persons wishing to participate in the consultation will be given an opportunity to make a presentation to the Commission setting out their position on the issues in this proceeding. However, the Commission remains of the view, as originally expressed in PN 98-12, that given the existing written processes in this proceeding, cross-examination of MTS is not necessary.
  4. Persons wishing to participate in the consultation are requested to notify the Commission of their intention to do so by contacting the CRTC office in Winnipeg listed below, or by using the Commission's toll-free number, by 30 October 1998. Persons intending to participate at the public consultation who require English or French language translation services or who have special needs are requested to advise the Commission of these requirements when notifying the Commission that they intend to participate. As with all Commission oral hearings, members of the public are invited to attend whether or not they wish to make a presentation.

  5. All dates and procedures set out in PN 98-12 remain as stated in that Notice. Interested persons are reminded that, pursuant to paragraph 10 of PN 98-12, any person who wishes to file written comments in this proceeding, without receiving copies of the various submissions, may do so by writing to the Commission at the above address by 20 November 1998.
