TELUS COMMUNICATIONS (EDMONTON) INC. - PROVISION OF PRIMARY TELEPHONE SET AND FORBEARANCE FROM THE REGULATION OF TERMINAL EQUIPMENT

  1. TELUS Communications (Edmonton) Inc. (TCEI) has proposed to eliminate the provision of one standard telephone set for each residential and business individual line service. The company proposed that individual line customers who have a standard telephone from the company would assume ownership and responsibility for the telephone set at no charge and with no change to the individual line rate. TCEI also requested the Commission to forbear from regulation with respect to the sale, lease and maintenance of all terminal equipment. This application was made under Tariff Notice (TN) 89, dated 7 July 1998. The proposed effective date for the tariff revisions and terminal equipment forbearance is 1 January 1999.

In a separate proceeding initiated by Form of Regulation for TELUS Communications (Edmonton) Inc., Telecom Public Notice CRTC 98-3, 23 February 1998 (PN 98-3), the Commission is in the process of determining the appropriate regulatory regime for TCEI and the basic residence exchange rate to be implemented on 1 January 1999. Given the nature of the issues in TN 89, any determinations made in this proceeding may impact the determinations to be made in the proceeding initiated by PN 98-3.
  PROCEDURE
  3. TCEI is made party to this proceeding. Other parties wishing to participate in this proceeding must notify the Commission of their intention to do so by writing to Mrs. Laura M. Talbot-Allan, Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, fax: (819) 953-0795, by 31 August 1998. Parties are to indicate in the notice their Internet email address, where available. If parties do not have access to the Internet, they are to indicate in their notice whether they wish to receive disk versions of hard-copy filings. The Commission will issue a list of interested parties.
  4. Parties who may have filed comments on TN 89 prior to the issuance of this Public Notice will be added to the list of interested parties and their comments will be added to the record of this proceeding. If they have not already done so, such parties are to provide a copy of their comments to TCEI by 2 October 1998.
  5. TCEI is directed to publish an announcement of the proposed tariff revisions in local newspapers, including The Edmonton Journal and The Edmonton Sun, by 31 August 1998 indicating that comments may be made to the Commission, with a copy to TCEI, by 2 October 1998.
  6. Parties may address interrogatories to TCEI. Any such interrogatories must be filed with the Commission and served on TCEI by 4 September 1998.
  7. Responses to interrogatories are to be filed with the Commission and served on all registered parties by 18 September 1998.
  8. Parties may file comments with the Commission, serving a copy on TCEI, by 2 October 1998.
  9. TCEI may file a reply to any comments made, serving a copy on all registered parties, by 9 October 1998.
  10. Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
