  Public Notice CRTC 1998-10
  The Commission has received the following applications:
  1. ACROSS CANADA
  Application (199715661) by 1163031 ONTARIO INC. to amend the broadcasting licence to carry on the national English-language (Specialty Television Service) known as Outdoor Life by amending condition of licence No. 2 which reads as follows:
   2. The licensee shall devote to the distribution of Canadian programs not less than 30% of the broadcast day, and not less than 30% of the evening broadcast period.
  Outdoor Life is seeking to amend the above condition of licence to be able to average its Canadian program exhibition obligations over the broadcast year rather than over the broadcast day. Outdoor Life notes that the Commission authorized the majority of English-language specialty services licensed in 1996 to calculate their exhibition of Canadian programs averaged over the broadcast year. The amended condition of licence would read as follows:
   2. The licensee shall devote to the distribution of Canadian programs not less than 30% of the broadcast day averaged over the broadcast year, and not less than 30% of the evening broadcast period.
  Outdoor Life also seeks to amend condition of licence No. 4(a) which reads as follows:
   4(a) Subject to subsection (b) and (d), the licensee shall not distribute more than eight minutes of advertising material during each clock hour.
  Outdoor Life is seeking to amend the above condition of licence to be able to distribute 12 minutes of advertising material during each clock hour rather than eight minutes. The amended condition of licence would read as follows:
   4(a) Subject to subsection (b) and (d), the licensee shall not distribute more than 12 minutes of advertising material during each clock hour.

  Application (199716536) by FAIRCHILD TELEVISION LTD. to amend the broadcasting licence to carry on the national Chinese language (Specialty Television Service) by amending condition of licence No. 8 which reads as follows:
   8. During each clock hour, the licensee shall broadcast not more than eight minutes of commercial messages of which no more than four minutes shall be local commercial messages.
  Fairchild Television Ltd. is seeking to amend the above condition of licence to be able to distribute 12 minutes of advertising material during each clock hour. As well, the applicant seeks to increase the maximum number of minutes which can be dedicated to local commercial messages. The amended condition of licence would read as follows:
   8. During each clock hour, the licensee shall not distribute more than 12 minutes of commercial messages of which no more than six minutes shall be local commercial messages.

   7. During each clock hour, the licensee shall broadcast no more than eight minutes of commercial messages of which no more than four minutes shall be local commercial messages.
  Fairchild Television Ltd. is seeking to amend the above condition of licence to be able to distribute 12 minutes of advertising material during each clock hour. It also seeks to increase the maximum number of those minutes which it can dedicate to local commercial messages. The amended condition of licence would read as follows:

  4. LINDSAY, Ontario
  Application (199712360) by LINDSAY CATV SYSTEM LIMITED for an exemption, from the distribution and linkage requirements imposed under subsection 20(1) of the Broadcasting Distribution Regulations.
  Lindsay CATV System Limited is proposing to be allowed to link Canadian and foreign signals across tiers as opposed to present regulatory requirements for linkage only within tiers. This means that foreign services could be linked with Canadian specialty and Pay TV services distributed on the basic service and/or in other tiers.

In the event that the application is brought to the oral phase of a hearing it would be helpful to the Commission if you provide reasons why your written comments are not sufficient and an appearance is necessary;
   Your intervention will be considered by the Commission, and will form part of the public record of the proceeding without further notification to you, provided the procedure set out above has been followed. You will be contacted only if your submission raises procedural questions.
