Notice of Public Hearing CRTC 1998-6

ISSUE NO. 1

The Commission will hold a public hearing commencing on 12 November 1998, at the Conference Centre, Phase IV, 140 Promenade du Portage, Hull, Quebec, to consider the following:

1. ACROSS CANADA

Application (199804175) by BELL SATELLITE SERVICES INC. for a broadcasting licence to carry on a national direct-to-home (DTH) pay-per-view (PPV) television programming undertaking. The proposed service would consist of up to 30 video signals, 22 of English language programming and 8 signals of French language programming. If the number of signals offered was to move above or below 30 in total, the number of signals dedicated to English and French language programming would vary proportionately, i.e. 75%/25%. However, the minimum number of French language pay-per-view signals would be no less than 5 at any time.

As part of the English language PPV service, the applicant proposes to offer up to 10% of foreign programming in languages other than English and French.

2. ACROSS CANADA

Application (199804068) by TELEVISION NORTHERN CANADA INCORPORATED (TVNC) for a broadcasting licence to operate a national aboriginal television programming network, to be called Aboriginal Peoples Television Network, upon surrender of the current licences issued to TVNC. The network would broadcast programs in English and French as well as in Aboriginal languages, directed to aboriginal and non-aboriginal persons in both the north and south of Canada and would be distributed by satellite.

The applicant also requests that its programming service be distributed on a mandatory basis as part of the basic service by Class 1 and 2 distribution licensees (such as cable) pursuant to subsection 17(5) of the Broadcasting Distribution Regulations (the Regulations) and by DTH distribution undertakings pursuant to subsection 37(b) of the Regulations. In the case of Class 3 terrestrial distribution undertakings, the applicant is proposing that the service be optional to basic.

The applicant is proposing a maximum monthly per-subscriber fee of $0.15; and that the proposed service would continue to be free of charge in those 96 communities which currently receive TVNC via local low power transmitters.

Since the proposed service includes TVNC's existing services, approval of this application would eliminate the need to consider the renewal of TVNC's current licences.

PROPOSED FEE

The applicant proposes to charge a basic monthly fee of $45.00 for the distribution of these services. For Class 3 licensees, the basic monthly fee is not regulated pursuant to the Broadcasting Distribution Regulations.

4. SWIFT CURRENT, Saskatchewan

Application (199804456) by C.O.R.B. SWIFT CURRENT & DISTRICT INC., P.O. Box 1270, Swift Current, Saskatchewan, S9H 3X4, for a broadcasting licence to carry on a (radiocommunication) distribution undertaking at Swift Current, to distribute in non-encrypted mode, using one radio transmitter operating on a frequency of 95.7 MHz (channel 239A) with an effective radiated power of 440 watts, the programming service of the CBC-FM English-language Radio Network.

The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least ten days prior to the hearing, that it is technically acceptable.

Application (199805959) by CKIK-FM LIMITED for a broadcasting licence to carry on an English-language radio network for the purpose of broadcasting all pre-season, regular and play-off football games of the Calgary Stampeders for the 1999, 2000 and 2001 seasons of the Canadian Football League.

The Commission notes that the programming would be originating from CHQR-AM Calgary.

B) Application (199803375) by NORTH SHORE CABLE LTD., P.O. Box 310, Sorrento, British Columbia, V0E 2W0, for authority to acquire the assets and for a broadcasting licence to continue the operation of the cable distribution undertaking serving Scotch Creek, Celista, Anglemont and Magna Bay, under the same terms and conditions as the current licence.
