Decision

Ottawa, 2 April 1998

Decision CRTC 98-99

TMN Networks Inc.

Eastern Canada and Igloolik, Hall Beach, Pond Inlet, Arctic Bay, Resolute Bay and Grise Fiord, Northwest Territories - 199800834

Licence amendment for MOVIEPIX

1.  Following Public Notice CRTC 1998-19 dated 3 March 1998, the Commission approves the application to amend the broadcasting licence for the English-language pay television programming undertaking serving Eastern Canada, MOVIEPIX, by authorizing the licensee to provide its programming service to Igloolik, Hall Beach, Pond Inlet, Arctic Bay, Resolute Bay and Grise Fiord, Northwest Territories.

2.  The communities subject to this decision are in the service area licensed to the MOVIEMAX service provided by WIC Premium Television Ltd. (WIC) (formerly Allarcom Pay Television Limited). Technical changes by WIC have resulted in the service no longer being receivable in these locations.

3.  Approval of TMN Networks Inc.'s (TMN) application will allow cable subscribers in the above-noted communities to have access to MOVIEPIX, until such time as WIC is able to re-establish MOVIEMAX.

4.  Accordingly, the authorization for the provision of MOVIEPIX to the communities noted above will cease when and if the satellite transponder configuration or the technology is adjusted to facilitate adequate signal reception of the MOVIEMAX service provided by WIC. The Commission notes that TMN has undertaken to cease offering its service at such time.

5.  The Commission notes that in Decision CRTC 98-2 dated 7 January 1998, it approved a similar application by TMN to provide The Movie Network to these same communities.

This decision is to be appended to the licence.
