    New television programming undertaking

    1. Following Notice of Public Hearing CRTC 1998-2 dated 20 March 1998, the Commission approves the application for a broadcasting licence for a French-language television programming undertaking at Rivière-du-Loup, on channel 29 with an effective radiated power (ERP) of 18,100 watts, with transmitters as listed below, to broadcast local programming and rebroadcast the programming of CFJP-TV (TQS) Montréal, received via satellite.

    2. Subject to the requirements of this decision, the Commission will issue a licence expiring 31 August 2004. This licence will be subject to the conditions specified in this decision and in the licence to be issued.

    3. The Commission notes that the licensee operates at Rivière-du-Loup, a radiocommunication distribution undertaking (CFTF-TV and its transmitters) which rebroadcasts the programming of CFJP-TV, received via satellite. The licensee has applied for a television programming undertaking licence as it now intends to broadcast 28 minutes per week of original local programming which will also be rebroadcast, representing a total of 2 hours and 57 minutes of local programming per broadcast week. This local programming will be made up of station identifications, promotional material, fill-in programming and press releases from various local organizations, including the Edmundston region, as well as weather reports.

    4. The Commission will issue a licence for authority to carry on the proposed new television programming undertaking only at such time as the licensee surrenders the licence currently issued for the radiocommunication distribution undertaking CFTF-TV, for cancellation by the Commission.

    5. The Commission notes that the licensee has not yet completed the construction and commenced operation of the transmitters at Baie-Comeau, Sept-Îles, and Forestville. Consequently, the Commission reiterates the approval for these transmitters that was granted in Decision CRTC 98-59 dated 24 February 1998.

    6. The Commission notes the licensee's commitment of $15,000 to the independent production sector, for each year of the licence term.

    7. Consistent with the licensee's commitment, it is a condition of licence that the station not solicit local advertising during the licence term.

    8. In addition to the 12 minutes of advertising material permitted by subsection 11(1) of the Television Broadcasting Regulations, 1987, the licensee may, by condition of licence, broadcast infomercials as defined in Public Notice CRTC 1994-139 and in accordance with the criteria contained in that public notice, as amended.

    9. It is a condition of licence that the licensee adhere to the guidelines on gender portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and accepted by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council.

    10. It is also a condition of licence that the licensee adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and accepted by the Commission.

    11. It is a condition of licence that the licensee adhere to the guidelines on the depiction of violence in television programming set out in the CAB's Voluntary Code Regarding Violence in Television Programming, as amended from time to time and accepted by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council.

    12. In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an Employment Equity Policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. The Commission notes that the licensee did not indicate in its application that it has put in place any measures in this regard. The Commission considers that the licensee should increase its efforts in this area.
