Change to licensed service area and new cable distribution undertaking

1. Following Notice of Public Hearing CRTC 1998-2 dated 20 March 1998, the Commission approves the application to change the licensed area for the cable distribution undertaking serving the above-noted communities by excluding Clinton, Bayfield, Brucefield, Holmesville and Varna.

2. The Commission also approves the licensee's application for a licence to carry on a separate cable distribution undertaking to serve Clinton, Bayfield, Brucefield, Holmesville and Varna. The operation of this undertaking will be regulated pursuant to Parts 1 and 2 ofthe Broadcasting Distribution Regulations (the regulations).

3. Subject to the requirements of this decision, the Commission will issue a Class 2 licence expiring 31 August 2002, the same expiry date as that of the licence for the Goderich and Huron Haven Village undertaking. The licence will be subject to the conditions specified in this decision and in the licence to be issued.

4. The Commission notes that the request for separate licences represents an intra corporate reorganization for estate planning purposes.

5. In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to distribute, at its option, the Global Communications Limited signal, CIII-TV, and CITY-TV (IND) Toronto, as part of the basic service.

6. The licensee is also authorized, by condition of licence, to distribute, at its option, WDIV (NBC), WXYZ-TV (ABC) and WTVS (PBS) Detroit, Michigan, as well as WTOL-TV (CBS) Toledo, Ohio, as part of the basic service.

7. The licensee may receive any authorized signals over the air, or from any licensed or exempted Canadian broadcasting distribution undertaking authorized to provide signals to other broadcasting distribution undertakings. The Commmission notes that the licensee intends to receive the above-noted signals via satellite.

8. The licensee is relieved, by condition of licence, of the requirement of section 17 of the regulations that it distribute TFO, the French-language educational television programming service operated by TVOntario, on the basic band (channels 2 to 13), so long as the service is distributed as part of the basic service.

9. It is a condition of licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' Voluntary Code Regarding Violence in Television Programming, as amended from time to time and approved by the Commission.

10. In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an Employment Equity Policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It encourages the applicant to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
