Decision CRTC 98-206

Trumar Communications Inc.

Toronto and Cobourg, Ontario - 199801030

Acquisition of assets

1. Following Notice of Public Hearing CRTC 1998-2 dated 20 March 1998, the Commission approves the application by Trumar Communications Inc. (Trumar) for authority to acquire the assets of the radio programming undertaking CFMX-FM-1 Toronto and CFMX-FM Cobourg from Martin Rosenthal, and for a broadcasting licence to continue the operation of this undertaking.

2. The Commission will issue a licence to Trumar, expiring 31 August 2003, the current expiry date, upon surrender of the current licence. The licence will be subject to the same conditions as those in effect under the current licence, as well as to any other condition specified in this decision and in the licence to be issued.

3. In approving this application, the Commission has taken into account the fact that Trumar is the personal holding company of Martin Rosenthal, and that the net effect of this transaction is to transfer the assets of the undertaking to Trumar, without any change occurring in the control, programming or management of the licensee.

4. By condition of licence, the licensee is authorized to use Subsidiary Communications Multiplex Operations (SCMO) channels for the purpose of distributing a commercial Tamil-language service and a commercial Persian-language service, produced by Radio Sedaye Iran.

5. With respect to the conditions set out above, the licensee is expected to adhere to the guidelines set out in Appendix A to Public Notice CRTC 1989-23 dated 23 March 1989 entitled Services Using the Vertical Blanking Interval (Television) or Subsidiary Communications Multiplex Operation (FM).

6. It is a condition of licence that the licensee devote, in each broadcast week, 10% or more of its musical selections from content category 2 to Canadian selections and schedule these Canadian selections in a reasonable manner throughout each broadcast day.

7. The Commission reaffirms the particular importance it attaches to the development of Canadian talent and is satisfied with the annual budgets and the initiatives proposed by the licensee in the most recent renewal application. It encourages the licensee, during this licence term, to continue its efforts towards the support, development and on-air exposure of local and regional talent.

8. In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an Employment Equity Policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.

This decision is to be appended to the licence.
