Val d'Or; and Malartic, Quebec - 199714738 - 199714746

Change to licensed service area and new cable distribution undertaking

1. Following a Public Hearing in Saint John on 30 March 1998, the Commission approves the application to change the licensed area for the cable distribution undertaking serving Val d'Or by excluding Malartic.

2. The Commission also approves the licensee's application to operate a separate cable distribution undertaking to serve Malartic. The operation of this undertaking will be regulated pursuant to Parts 1 and 3 of the Broadcasting Distribution Regulations. The new undertaking will be interconnected via microwave to the local head end of the Val d'Or undertaking.

3. Subject to the requirements of this decision, the Commission will issue a licence expiring 31 August 2004, the same expiry date as that of the licence for the Val d'Or undertaking. This licence will be subject to the conditions specified in this decision and in the licence to be issued.

4. Consistent with Decision CRTC 95-683 dated 12 September 1995, the licensee is authorized to originate a video games service as a special programming service, offered on a discretionary basis, subject to the conditions of licence listed in that decision.

5. It is a condition of licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' Voluntary Code Regarding Violence in Television Programming, as amended from time to time and approved by the Commission.

6. In accordance with subsection 22(1) of the Broadcasting Act, the Commission will not issue a licence to the applicant unless it has received written notification from the Department of Industry, within twelve months of the date of this decision that it will issue a Broadcasting Certificate. No licence will be issued if the Commission does not receive this notification within said period or, where the applicant applies to the Commission within this period and satisfies the Commission that it is unable to obtain said notification before the expiry of this period and that an extension of time is in the public interest, within such further periods of time as are approved in writing by the Commission.

7. This authority will only be effective and the licence will only be issued at such time as construction of the undertaking is completed and it is prepared to commence operation. The licence will not be issued if construction is not completed within twelve months of the date of receipt of the Department of Industry notification referred to in the preceding paragraph or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot implement its authority before the expiry of this period and that an extension of time is in the public interest, within such further periods of time as are approved in writing by the Commission.

8. In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled Implementation of an Employment Equity Policy, the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
