ExpressVu Inc., on behalf of the partners of a limited partnership to be formed

Acquisition of the assets of the national DTH satellite distribution undertaking

1. Following a Public Hearing in the National Capital Region beginning on 16 February 1998, the Commission approves the applications by ExpressVu Inc. (the Company), on behalf of the partners of a limited partnership to be formed under the name and style of ExpressVu Limited Partnership - Société en commandite ExpressVu (the Partners of ExpressVu), for authority to acquire the assets of the Company and for a broadcasting licence to continue the operation of the national direct-to-home (DTH) satellite distribution undertaking, under the same terms and conditions as the current licence.

2. The Commission notes that, upon the completion of the proposed transactions, the Company will be the sole general partner, with BCE Inc., Canadian Satellite Communications Inc. and WIC Western International Communications Ltd. participating as limited partners.

3. The Commission will issue a licence to the Partners of ExpressVu expiring 31 August 2002, the current expiry date, upon surrender of the current licence. The operation of the undertaking will be subject to Parts 1 and 4 of the Broadcasting Distribution Regulations and the licence will be subject to the same conditions as those in effect under the current licence, as well as to any other condition specified in the licence to be issued.

4. The Commission notes that this licensee is subject to the Employment Equity Act that came into effect on 24 October 1996 (1996 EEA), and therefore files reports concerning employment equity with Human Resources Development Canada. As a result of a consequential amendment to the Broadcasting Act, the Commission no longer has the authority to apply its employment equity policy to any undertaking that is subject to the 1996 EEA.

This decision is to be appended to the licence.
