Telecom Costs Order CRTC 98-12

In re: Telecom Public Notice CRTC 97-39, BC TEL - Introduction of Provincial 9-1-1 Service

1. In a letter dated 10 March 1998, the B.C. Old Age Pensioners' Organization, Council of Senior Citizens' Organizations of B.C., Federated Anti-Poverty Groups of B.C., Senior Citizens' Association of B.C., West End Seniors' Network, Consumers' Association of Canada, B.C. Coalition for Information Access and End Legislated Poverty (BCOAPO et al.) applied for costs in connection with their participation in the above-noted proceeding. BCOAPO et al. submitted that they: (1) represented a class of subscribers who receive a benefit or suffer detriment as a result of this proceeding; (2) had participated in a responsible fashion; and (3) had contributed to a better understanding of the issues by the Commission.

2. In a letter dated 17 March 1998, BC TEL stated that it did not object to an award of costs to BCOAPO et al.

3. DIRECTIONS AS TO COSTS
|
4. The application of BCOAPO et al. for an award of costs in the above-noted proceeding is hereby approved.
|
5. The Commission considers that BCOAPO et al.'s participation contributed to a better understanding of the issues by the Commission. In the circumstances, the Commission considers that BCOAPO et al.'s application meets the requirements of section 56 of the Telecommunications Act and the criteria set out in subsection 44(1) of the CRTC Telecommunications Rules of Procedure (the Rules).

6. Costs awarded herein shall be subject to taxation in accordance with the Rules.

7. Costs awarded herein shall be taxed by Alastair Stewart.
|
8. BCOAPO et al. shall, within 30 days of the issue of this Order, submit a bill of costs and an affidavit of disbursements to the Taxing Officer and serve a copy thereof on BC TEL.
|
9. BC TEL may, within two weeks of the receipt of those documents, file comments with the Taxing Officer with respect to the costs claimed, and serve a copy thereof on BCOAPO et al.
|
10. BCOAPO et al. may, within two weeks of receipt of any comments by BC TEL, file a reply to BC TEL's comments, serving a copy thereof on BC TEL.
|
11. Costs are payable forthwith upon the issuance of the Taxation Order.
|
12. All documents to be filed or served by a specific date must be actually received, not merely sent, by that date.
