Deferral of Policy Process to Consider Options for Extending Protection of Program Rights

In Public Notice CRTC 1997-7, the Commission requested comments with respect to options for extending protection of program rights. Such rights are often referred to as advanced, or enhanced, substitution measures. The deadline for receipt of the first stage public comments is Friday, 11 April 1997.

On Tuesday, 8 April 1997, the Commission received a letter from the Canadian Association of Broadcasters (CAB) requesting a deferral of the process announced in Public Notice CRTC 1997-7. According to the CAB, analysis of the various approaches to enhanced rights protection has shown that there are severe limitations to each of them. The CAB considers that a new approach is necessary and that such an approach can best be found in the context of a broader proceeding dealing comprehensively with the future of Canadian programming.

The Commission notes that the proceeding outlined in Public Notice CRTC 1997-7 was initiated, in large measure, as the result of the urging of the CAB and its individual members. The Commission also agrees with the CAB that issues relating to program rights can best be addressed in a proceeding that will examine the future of Canadian programming in a comprehensive manner, on a date to be announced. It considers it appropriate, therefore, to defer indefinitely the public process set out in Public Notice CRTC 1997-7 and subsequently amended in Public Notice CRTC 1997-7-1. Comments received in connection with this process will be returned.
