PROPOSED AMENDMENTS TO THE RADIO REGULATIONS, 1986; TELEVISION BROADCASTING REGULATIONS, 1987; AND SPECIALTY SERVICES REGULATIONS, 1990
Pre-Clearance of Drug Commercials and Treatment Recommendations
The Commission's regulations governing the operation of radio, television and specialty services undertakings currently require licensees, prior to the broadcast of a commercial message for, or an endorsement of, a drug or device other than a veterinary biologic product, to which the Food and Drug Act applies, to obtain the approval of the Minister of National Health and Welfare (the Minister) in respect of the script for the message or endorsement. The regulations also require licensees to obtain the Minister's approval, prior to broadcast, of the script of a recommendation for the treatment, preventative or cure of a disease, disorder or abnormal physical state. The Minister has asked that the Commission amend its regulations by deleting these pre-clearance requirements since it is transferring the responsibility for pre-clearance of broadcast advertising in respect of these matters to the Canadian Advertising Foundation, an independent agency.
The Commission hereby proposes to amend the regulations by deleting from them the present references to drug commercials and treatment recommendations.
Copies of the proposed amendments are attached to this notice. All interested parties wishing to comment on the proposed amendments must send their submissions to the Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, by Monday, 7 April 1997.

REGULATIONS REPEALING PROVISIONS OF CERTAIN REGULATIONS REGARDING THE PRE-CLEARANCE OF COMMERCIAL MESSAGES BY THE MINISTER OF HEALTH
repeals
1. Section 5 of the Radio Regulations, 1986 is repealed.
2. Section 7 of the Television Broadcasting Regulations, 1987 is repealed.
3. Section 5 of the Specialty Services Regulations, 1990 is repealed.
