Proposed Amendments to the Cable Television Regulations, 1986 - Distribution and Linkage Requirements
|
In Public Notice CRTC 1996-121 dated 4 September 1996 and entitled "Distribution and Linkage Requirements", the Commission modified the distribution and linkage requirements for programming services that were previously set out in Public Notice CRTC 1994-60. Specifically, the Commission established new rules governing the distribution of Canadian pay television and specialty services, as well as Canadian and non-Canadian satellite services, by cable licensees holding a Class 1 licence, or a Class 2 licence for a system with 2000 or more subscribers. In addition, the Commission outlined in the notice requirements concerning the linkage of programming services distributed on a discretionary basis.

Attached to the present notice is a copy of a proposed amendment to the Cable Television Regulations, 1986 (the regulations). This amendment would incorporate, by reference, the requirements of Public Notice CRTC 1996-121 into subsection 10(2) of the regulations.

Parties wishing to comment on the proposed amendment must send their submissions to the Secretary General, Canadian Radio-television and Telecommunications Commission, Ottawa, Ontario, K1A 0N2, by Tuesday, 8 April 1997. While receipt of submissions will not be acknowledged, they will be considered by the Commission and will form part of the proceeding.

Whereas, pursuant to subsection 10(3) of the Broadcasting Acta, a copy of the proposed Regulations Amending the Cable Television Regulations, 1986, substantially in the annexed form, was published in the Canada Gazette, Part I, on , 1997, and a reasonable opportunity was thereby given to licensees and other interested persons to make representations to the Canadian Radio-television and Telecommunications Commission with respect thereto;

Therefore, the Canadian Radio-television and Telecommunications Commission, pursuant to subsection 10(1) of the Broadcasting Acta, hereby makes the annexed Regulations Amending the Cable Television Regulations, 1986.

REGULATIONS AMENDING THE CABLE TELEVISION REGULATIONS, 1986

1. Subsection 10(2) of the Cable Television Regulations, 1986 is replaced by the following:

(2) Except as otherwise provided pursuant to a condition of its licence, where a licensee distributes a programming service referred to in paragraph (1)(e), (f) or (h), the licensee shall distribute the service in accordance with the rules governing the distribution of the service as set out in Public Notice CRTC 1996-121, entitled Distribution and Linkage Requirements.

These Regulations change the Public Notice referred to in subsection 10(2) of the Cable Television Regulations, 1986 in order to establish new distribution and linkage requirements for programming services.
