WHEREAS MTS filed its Phase III Manual Update Report as an unscheduled submission that related to 1995 procedures and results;
WHEREAS MTS included proposed modifications resulting from an audit study produced in April 1996 which identified discrepancies between the study documentation and the actual procedures after the final filing date for 1995 updates together with other routine revisions;
WHEREAS BC TEL and NewTel filed their Phase III Manual Update Reports, with explanations, in accordance with the Proposed Revisions to the Phase III Manual Update Procedure, Telecom Letter Decision CRTC 89-26, 1 December 1989, Review of Regulatory Framework, Telecom Decision CRTC 94-19, 16 September 1994, Review of Phase III of the Cost Inquiry, Telecom Decision CRTC 94-24, 18 November 1994 and Implementation of
Regulatory Framework - Splitting of the Rate Base and Related Issues, Telecom Decision CRTC 95-21, 31 October 1995;
WHEREAS no comments on the proposed updates were submitted by interested parties;
WHEREAS the Commission has reviewed the proposed updates filed by BC TEL, NewTel and MTS and, with the exception of NewTel's proposal to reassign Centrex consoles and proprietary sets, finds them all acceptable;
WHEREAS NewTel indicated that because of successful bids for Centrex terminal sales by other vendors, a fully competitive Centrex terminal market now exists in its territory;
WHEREAS the company proposed to reassign Centrex consoles and proprietary sets contained in Tariff Items 190, Provincial Centrex and 194, National Centrex from the Access to the Competitive Terminal Multiline and Data (CT(MD)) category (i.e., from the Utility segment to the Competitive segment);
WHEREAS the Commission notes that NewTel is the only Stentor member company to propose this change to date;
WHEREAS this equipment has historically been assigned to the Access category because it was only available from the company;
WHEREAS since Centrex service is provided by all Stentor members, the Commission considers that it would be appropriate to seek comments on whether this change in assignment should be made not only for NewTel but also for the other Stentor members and has initiated a proceeding to deal with this matter in NewTel Communications Inc. - Proposed Phase III Manual Revisions to Reassign Centrex Consoles and Proprietary Sets to the Competitive Terminal Category and Associated Tariff Revisions, Telecom Public Notice CRTC 97-3, 27 February 1997, (Public Notice 97-3);
WHEREAS the Commission expects to dispose of NewTel's proposed update as part of the proceeding initiated by Public Notice 97-3 -
IT IS HEREBY ORDERED THAT:
1. Except for NewTel's proposed update to reassign Centrex consoles and proprietary sets, the proposed Phase III Update Reports filed by BC TEL, MTS and NewTel are approved.
2. The amended pages to MTS's Phase III Manual, which are to include all updates approved in this Order that are relevant to the production of the company's 1995 Split Rate Base (SRB) results, are to be filed on a date to be specified when the Commission issues its Order with respect to the company's proposed Phase III procedures for new Broadband costing.
3. Copies of the amended pages to MTS's Phase III Manual are to be served on their Phase III interested parties by the same date.
4. The amended pages to BC TEL's and NewTel's Phase III Manuals, which are to include all updates approved in this Order that are relevant to the production of each company's 1996 SRB results, are to be filed with the Commission by 30 June 1997.
5. Copies of the amended pages to BC TEL's and NewTel's Phase III Manuals are to be served on their respective Phase III interested parties by the same date.
