IN THE MATTER OF an application by TELUS Communications Inc. (TCI) under Tariff Notice 850 dated 22 November 1996, as amended by Tariff Notice 850A dated 10 December 1996, for approval of tariff revisions to General Tariff Item 201 related to unsolicited live voice and facsimile (fax) calls for the purpose of solicitation.
WHEREAS TCI proposed that permitted unsolicited fax calls for purposes of solicitation be restricted to the hours between 9:00 A.M. and 9:30 P.M. Monday to Friday and between 10:00 A.M. and 6:00 P.M. Saturday and Sunday;
WHEREAS TCI proposed that, following a customer’s request, the interval in which telemarketers must remove a customer’s name and telephone number from their calling lists be 7 calendar days for unsolicited fax calls, while 30 calendar days shall remain in effect for live voice calls; and
WHEREAS TCI’s proposals are substantially similar to those approved by the Commission for Bell Canada and BC TEL in Telecom Order CRTC 96-1229, dated 7 November 1996 -
IT IS HEREBY ORDERED THAT:
1. Tariff Notices 850 and 850A are approved on an interim basis is approved on an interim basis subject that the permitted calling hours proposed by TCI for unsolicited fax messages are to refer to those of the called party.
2. TCI is to issue, forthwith, tariff pages reflecting the changes stated in 1 above.
