Telecom Order CRTC 97-82
|
IN THE MATTER OF an application by Télébec ltée (Télébec) under Tariff Notice 116 dated 4 November 1996 (TN 116), for approval of tariff revisions to reintroduce and modify the text of the Terms of Service relating to push-button dialing, to remove certain equipment and terminals, to make revisions to its digital network services and minor corrections to its services name "Étoiles".

WHEREAS, in Telecom Order CRTC 96-737 dated 6 July 1996, the Commission authorized Télébec to include push-button dialing in the basic service of all its subscribers beginning on 1 August 1996;
|
WHEREAS following Tariff Notices 98 and 103 dated 28 March 1996 and 3 June 1996, respectively, the Commission understood that push-button dialing (tone service) would be available everywhere in the company's territory beginning on 1 August 1996;
|
WHEREAS the Commission learned that push-button dialing (tone service), for which all Télébec subscribers are being billed since 1 August 1996, is not available everywhere in the company's territory;
|
WHEREAS in TN 116 Télébec proposed to define push-button dialing as allowing telephone calls to be routed with a telephone set equipped with special push-buttons instead of a rotary dial;
|
WHEREAS the Commission is of the view that the definition of push-button dialing proposed by Télébec would include not only tone service but also dialing with a digital pulse telephone set;
|
WHEREAS the Commission notes that digital pulse dialing is a function of the telephone set while tone dialing is a function of both the telephone set and the switch;
|
WHEREAS the Commission considers the definition of push-button dialing proposed by Télébec to be erroneous;
|
WHEREAS the Commission is of the view that the company should not be able to bill for a service that is not available; and
|
WHEREAS the Commission is of the view that the other tariff revisions proposed by Télébec in TN 116 are acceptable -

IT IS HEREBY ORDERED THAT:
|
1. TN 116 is approved subject to the following modifications to Item 2.1.7.7:
|
(a) Replace the title [TRANSLATION] "Push-button dialing" with "Push-button dialing (tone service)";
|
(b) Delete the first paragraph;
|
(c) Amend the second paragraph to read as follows:
|
[TRANSLATION] "Push-button dialing (tone service) is included in the local basic service of all customers except those who do not have access to push-button dialing (tone service), including those served by a four party line service."; and
|
(d) In the third paragraph, [TRANSLATION] "Push-button dialing (tone service)" is to be inserted in place of "Push-button dialing".

2. Télébec is to publish within five days after the date of this Order revised pages reflecting the modifications set out in 1 above.
|
3. Télébec is directed to cease immediately collecting charges for push-button dialing (tone service) from subscribers for whom this service is not available as of today's date.
