1. On 6 May 1997, Bell Canada (Bell) filed Tariff Notice 6002 (TN 6002) seeking approval of an introductory promotional offer applicable to its Calling Features consisting of one of the following four options:
(i) waiver of the monthly rate in the first month of subscription (31 days);
(ii) waiver of the monthly rate in the first two months of subscription (62 days);
(iii) monthly subscription of features for $1.00 for 31 days; or
(iv) monthly subscription of features at 50% off the regular monthly rate for 62 days.
2. Bell proposed that the promotion would be made available to customers in designated exchanges who are not subscribed to the Calling Features at the start of the promotion period.
3. On 22 May 1997, Bell filed Tariff Notice 6002A (TN 6002A), in which the company amended the terms of the proposed promotion in a number of ways, most notably: (i) the number of promotional options was reduced from the above-noted four to two; (ii) the two promotions proposed would consist of either (1) waiver of the monthly rate in the first month of subscription (31 days), or (2) monthly subscription of features at 50% off the regular monthly rate for two months (62 days); (iii) the addition of a provision in the proposed tariff indicating that the offer would be available only in designated exchanges as determined by Bell; and (iv) the addition of a provision indicating that although the company may offer different promotion options to customers in different exchanges during the promotion, any customer may upon request subscribe to either promotional offer.
4. In Telecom Order CRTC 97-738 issued on 2 June 1997, the Commission denied approval of TN 6002. The application was denied on the basis that it was unclear based upon the wording of the proposed tariff whether Bell or the customer would determine which of the four promotional options would be applicable to any given customer. In addition, the Commission stated that the proposed tariff would give Bell considerable discretion as to the circumstances under which different rates would apply, and considered that the tariff was potentially unjustly discriminatory and likely to be contrary to subsection 27(2) of the Telecommunications Act.
5. On 3 June 1997, Bell filed Tariff Notice 6002B (TN 6002B) proposing a further amendment to the application, clarifying that the designation by the company of exchanges in which the promotion would be available would be based on the level of subscription in any given exchange to the company's Calling Features.
6. In light of the foregoing, the Commission considers the terms of the proposed promotion in TN 6002A, as amended by TN 6002B, to be appropriate. Accordingly, the proposed tariff revisions are approved.
