On 22 November 1996, MTS NetCom Inc. (MTS) submitted an application for the approval of (1) tariff revisions for the introduction of a Province-Wide Enhanced 9-1-1 service (E9-1-1), and (2) a related agreement between MTS and municipalities.

1. MTS proposed an E9-1-1 rate of $0.80 per month per eligible line without the participation of Winnipeg, which would be reduced to $0.25 with Winnipeg's participation. Winnipeg is currently served under a 9-1-1 Special Facilities Tariff (SFT) service.

2. The Commission granted the proposed service interim approval in Telecom Order CRTC 96-1597. The Commission also issued Telecom Public Notice CRTC 97-1 to solicit comments regarding the service and the agreement.

3. Rogers Cantel Inc. (Cantel) submitted that the mark-up for the service, under the scenario where Winnipeg is included, is greater than the 10% that has been allowed by the Commission in previous E9-1-1 filings. Cantel submitted that the rate whereby Winnipeg participates should be reduced accordingly. MTS submitted that the proposed rate is the result of normal rounding practice by the company, for ease of administration and for ease of understanding by subscribers. MTS also referred to Telecom Order CRTC 96-1176, pertaining to the E9-1-1 service in Alberta, which states that "in the Commission's view, a mark-up in the 10% range is appropriate".

4. With respect to the MTS E9-1-1 service, the Commission is of the view that the mark-up included in the $0.25 rate is appropriate in the circumstances.

5. With respect to the participation of Winnipeg, the Commission is of the view, consistent with previous orders dealing with 9-1-1, that where municipalities are served by a stand-alone system provided on the basis of an SFT contract, they should be allowed, if they so wish, to continue under the SFT arrangement until their contract expires. The Commission is, however, of the view that the use of the General Tariff would be appropriate once the contract expires. The Commission considers that it is in the public interest that rate averaging be used in this case, as it allows the greatest number of people to obtain the E9-1-1 service at the lowest price.

6. In light of the foregoing, the Commission orders that:
|
|
(a) Tariff Notice 235 and the accompanying agreement are given final approval; and
|
|
(b) The 9-1-1 service for Winnipeg is to be transferred to the General Tariff no later than the expiry of its 9-1-1 SFT contract with the company.
