Telecom Order CRTC 97-616

Ottawa, 9 May 1997

The Commission received a letter dated 5 March 1997 from Telecom Media International Italy-Canada Inc. (Telecom Media), requesting a contribution exemption for circuits used for the provision of data services.

File No.: 97-8626-T19-01

Telecom Media affirmed in an affidavit that the circuits are resold solely for the provision of data services and that the company does not offer voice services.

By letter dated 4 April 1997, Bell Canada (Bell) noted that the affidavit attached to Telecom Media's application affirmed that the circuits in question are solely to provide data services to its customers and satisfies the Commission’s evidentiary requirements for a provider of data services only.

Accordingly, Bell agreed with the requested exemption.

The Commission notes that the affidavit affirms that the circuits are for data services only and considers that Telecom Media's application meets the Commission’s evidentiary requirements for an exemption from contribution.

In light of the foregoing, the Commission orders that:

Telecom Media's application is approved effective 5 March 1997, the date of application.

Allan J. Darling
Secretary General
