IN THE MATTER OF an application by TELUS Communications Inc. (TCI) [formerly AGT Limited] under Tariff Notice 809 (TN 809) dated 12 July 1996, proposing revisions to the Company's Radio Paging - Network Access Service tariff to expand the service definition to include voice messaging and telephone answering applications, and to propose unified and revised rates for telephone numbers and network access for these services.
WHEREAS in TN 809, TCI proposed to change the name of the tariff to Messaging Services - Network Access to reflect the proposed changes;
WHEREAS TCI stated that technological advancements and the convergence of various types of messaging services provided by messaging service providers have created a market condition whereby the services being offered overlap, are competitive and are difficult to segregate;
WHEREAS interventions were received from Canadian Association of Message Exchanges, Inc. (CAM-X), Rogers Cantel Inc. (Cantel), On-Line Services, and Hi-Flight Engineering Ltd.;
WHEREAS TCI filed replies to these interventions;
WHEREAS CAM-X and On-Line Services supported the proposed rate decrease for telephone numbers from $2.76 to $0.14 ($14.00 per 100 numbers) applicable to telephone answering service providers;
WHEREAS Cantel and Hi-Flight Engineering Ltd. opposed the rate increase for radio paging access numbers from $10.35 to $14.00 per 100 numbers;
WHEREAS Cantel argued, among other things, that TCI's proposal unfairly discriminates against radio paging service providers;
WHEREAS TCI stated that the reason for filing a combined rate structure for messaging services was that service suppliers could now supply the whole range of messaging services from a single platform and that the telephone company could no longer distinguish between the services and, therefore, could no longer maintain different tariffs for the services;
WHEREAS the Commission considers that it is appropriate to have a single rate for telephone numbers for these services;
WHEREAS TCI proposed a rate increase for the analogue element of the service from $17.09 to $42.10;
WHEREAS Cantel, Hi-Flight Engineering Ltd., and On-Line Services objected to the proposed increase in the Analogue Link rate;
WHEREAS Cantel further argued that the Commission had set the Analogue Link rate at $17.09 in Telecom Order CRTC 94-630 (Order 94-630) and that TCI could therefore not change it;
WHEREAS TCI responded that in Order 94-630 the Commission had set rates in the absence of cost studies but had indicated that it would consider different rates if the company provided cost support for proposed rate changes;
WHEREAS the Commission notes that TCI filed a cost study in support of the proposed Analogue Link rate;
WHEREAS in a late comment, dated 17 December 1996, Hi-Flight Engineering Ltd. noted that the proposed service charge for telephone numbers applies to each block of 100 numbers rather than on a per service order basis, as it does for the blocks of telephone numbers in the Wireless Service Operator tariff; and
WHEREAS the Commission considers that a service charge per service order is more reflective of the associated costs than a charge per block of 100 numbers -
IT IS HEREBY ORDERED THAT:
1. The proposed tariff revisions are approved on an interim basis with the modification that the service charge for telephone numbers be applicable on a per service order basis
2. TCI is directed to issue revised tariff pages reflecting the above.
