Telecom Order CRTC 97-224
IN THE MATTER OF an application by MFS Communications of Canada Inc. (MFS) dated 23 December 1996, requesting an exemption from contribution charges for certain Canada-U.S. services provided by AT&T Canada Long Distance Services Company.
Reference: 96-2159
WHEREAS in support of its application, MFS provided an affidavit dated 23 December 1996 identifying the circuits which are the subject of the application and affirming that MFS is a data-only service provider, and that the services in question are used solely by MFS to provide data services to its customers;
WHEREAS by letter dated 22 January 1997, Bell Canada (Bell) agreed that the affidavit satisfies the evidentiary requirements in support of such an exemption, and accordingly agreed with the requested exemption;
WHEREAS the Commission is of the view that MFS has met its evidentiary requirements with respect to data circuits as set out in Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993 and notes that Bell has agreed with the exemption -
IT IS HEREBY ORDERED THAT:
MFS application is approved effective the date of application.
