Telecom Order CRTC 97-1959
On 12 December 1997, Stentor Resource Centre Inc. (Stentor) filed, on behalf of BC TEL, Bell Canada, Maritime Tel & Tel Limited (MT&T), MTS NetCom Inc., The New Brunswick Telephone Company, Limited, and TELUS Communications Inc. (the companies), a proposed Interconnection Agreement for the Provision of 9-1-1 Service to a Competitive Local Exchange Carrier (CLEC) together with a number of schedules [the Agreement].

1. The Commission is of the preliminary view that certain changes to the Agreement are appropriate.
2. In light of the foregoing, the Commission orders that:
3. The Agreement is granted interim approval with the following modifications:
a) delete sections 3.3, 5.3, 7.3 and 7.6;
b) revise section 7 to make the companies' limitations of liability consistent with the limitations of liability set out in their respective terms of service;
c) revise section 8 to read as follows:
The CLEC and the Company shall, during the term of this Agreement, maintain sufficient insurance to cover their respective obligations under this Agreement and shall provide evidence of same to the other or, if either the CLEC or the Company is self-insured, provide to the other satisfactory evidence that the CLEC and/or the Company, as the case may be, is and will be, at all relevant times, in a position to face successfully its monetary obligations stemming from liability under this Agreement.
d) delete the last paragraph of schedule B for MT&T.
e) The companies file forthwith with the Commission, for information purposes, a revised agreement consistent with the above.
