By fax dated 3 February 1997, Pri-Net applied for exemption from contribution, providing an affidavit dated 10 January 1996 (sic: should be 1997) with respect to the Centrex lines which it planned to use. By letter dated 22 August 1997, Bleam Star Communications Inc., operating under the name PriNet (not Pri-Net as noted above) applied for exemption from contribution, providing an affidavit dated 22 August 1997 affirming that the Megalink services which are the subject of its application are used solely to provide local services to its customers. PriNet requested an effective date retroactive to the date of installation of the circuits.

1. By letter dated 15 September 1997, Bell Canada (Bell) stated that the Megalink facilities in question appear to be operating in the manner described by PriNet. Further, Bell noted that the affidavit provided by PriNet satisfies the Commission's evidentiary requirements with respect to circuits used only for local resale, pursuant to Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993. Accordingly, Bell agreed with the requested exemption.
2. By letter dated 26 September 1997, PriNet provided a revised affidavit. By letter dated 28 October 1997, PriNet reviewed the history of its application and submitted that the effective date of its requested exemption should be February 1997.
3. The Commission is of the view that PriNet's affidavit dated 22 August 1997 satisfies its evidentiary requirements with respect to circuits used only for local resale and that the application should be approved on that basis.
4. The Commission notes that PriNet's application of February 1997 was deficient in two respects. First, it pertained to Centrex instead of Megalink services. Second, the affidavit supporting the application was incorrectly dated. However, the Commission notes that these mistakes were corrected in the affidavit of 22 August 1997.
5. Given that the original application was filed on a timely basis and given that the deficiencies of the original application were corrected in the affidavit of 22 August 1997, PriNet's application is approved effective the date of installation.
