Telecom Order CRTC 97-1843
On 5 October 1997 The Corporation of the City of Thunder Bay - Telephone Division (Thunder Bay) filed with the Commission, under Tariff Notice 46, proposed tariff pages for the provision of Directory File Service (DFS).

1. In Telecom Order CRTC 97-1244, 5 September 1997 (Order 97-1244), the Commission dealt with a request from Avalon Publishing Corporation (Avalon) that the Commission direct Thunder Bay to make non-confidential residential and business directory listing available in machine-readable form for a fee.
2. In Order 97-1244, the Commission directed, among other things, that:
a) Thunder Bay provide a DFS to independent directory publishers in a manner consistent with Provision of Directory Database Information and Real-Time Access to Directory Assistance Databases, Telecom Decision CRTC 95-3, 8 March 1995 (Decision 95-3), as amended by Order in Council P.C. 1996-1001, 25 June 1996 (P.C. 1996-1001), and by Telecom Order CRTC 96-1522, 23 December 1996 (Order 96-1522);
b) Thunder Bay issue, within 30 days, interim tariffs for the provision of a DFS to independent directory publishers at the interim rates specified in Decision 95-3 and under terms and conditions similar to those in the interim tariffs and associated licensing agreements in place for the telephone companies subject to Decision 95-3 (as amended by P.C. 1996-1001) and Order 96-1522;
c) absent confirmation from Avalon to Thunder Bay within ten days that it wished to subscribe to the service, the interim tariffs specify that listing information would be available 90 days from the date of a request for the service.
3. By letter dated 27 November 1997, Avalon expressed concerns with regard to Thunder Bay's proposed tariff pages, and provided the Commission with a copy of a letter dated 19 September 1997 from Avalon to Thunder Bay requesting that directory database information be made available to it pursuant to Order 97-1244.
4. Thunder Bay filed a response to Avalon's comments by letter dated 2 December 1997.
5. On 9 December 1997, Thunder Bay provided the Commission with a copy of its proposed license agreement associated with the provision of DFS.
6. The Commission has reviewed the proposed interim tariffs filed by Thunder Bay and the associated license agreement, as well as the above-noted correspondence, and considers that changes are required to ensure that the interim tariffs conform to Order 97-1244 and are consistent with the interim tariffs of the telephone companies subject to Decision 95-3, as amended by P.C. 1996-1001 and Order 96-1522.
7. In light of the above, the Commission approves Thunder Bay's proposed tariffs for DFS on an interim basis, subject to the changes noted below.
8. Proposed Tariff Item 4.07(a) is to be replaced with the following: "Listings omitted, at the request of the customer, from Thunder Bay's published directory."
9. Tariff Item 4.09 is to be replaced with the following: "Directory listing information will be made available 18 December 1997."
10. Tariff Item 4.11 is to be deleted.
11. Thunder Bay is to issue forthwith interim tariff pages reflecting the changes set out above.
12. Thunder Bay is to file the license agreement forthwith for the Commission's approval, serving a copy on Avalon, replacing references limiting the licensee to the production of "paper telephone directories" with references limiting the licensee to the production of "telephone directories".
