Telecom Order CRTC 97-1840

On 28 November 1997, NewTel Communications Inc. (NewTel) filed an ex parte application for approval of tariff revisions.

1. The Commission notes that NewTel's proposed promotion is similar in structure to previous promotions provided by NewTel and that the various promotions were in effect over the period of 13 January 1997 to 31 December 1997.

2. In view of the similarity between the promotions and their total combined duration, the Commission finds that the proposed promotion does not constitute a legitimate promotion of limited duration. The revisions proposed under Tariff Notice 550 are therefore not exempt from the imputation test requirements established in Review of Regulatory Framework - Targeted Pricing, Anti-Competitive Pricing and Imputation Test for Telephone Company Toll Filings, Telecom Decision CRTC 94-13, 13 July 1994.

3. In light of the foregoing, the Commission orders that:

Tariff Notice 550 is denied and the company is directed to provide an abridged copy of the application for the public record in all relevant public examination rooms within two business days.
