Telecom Order CRTC 97-182
IN THE MATTER OF an application filed by Bell Canada (Bell) under Tariff Notice 5890 dated 6 December 1996, proposing tariff revisions providing the underlying unbundled components for access to the Public Switched Telephone Network by Alternate Enhanced Service Providers for the purpose of providing Advanced Intelligent Network (AIN) service features.
WHEREAS AT&T Canada Long Distance Services Company (AT&T Canada) stated that the AIN Interconnection components are bottleneck elements and that, therefore, any mark-up for such services used by service providers already paying explicit contribution is unacceptable;
WHEREAS AT&T Canada cited a number of recent Commission rulings where the Commission had found that a mark-up for a particular bottleneck service was not appropriate;
WHEREAS AT&T Canada stated that the proposed AIN Interconnection Confidentiality Agreement does not afford the same level of protection for confidential information as ensured by the existing Carrier Services Group (CSG) agreement between AT&T Canada and Bell;
WHEREAS AT&T Canada requested that the Commission direct the telephone company to remove the requirement for the AIN Interconnection Confidentiality Agreement where a CSG agreement already exists;
WHEREAS Bell submitted that a mark-up is required to recover the Utility segment fixed and common costs, while the contribution recovers the shortfall in the access and common category costs;
WHEREAS Bell cited a number of recent orders where the Commission had approved rates for bottleneck components that included a mark-up;
WHEREAS Bell stated that that the existing CSG agreement between AT&T Canada and Bell is related to its entry into the public long distance business and contains terms and conditions associated with operating procedures pertaining to the provision of public long distance service which are not pertinent to the provision of AIN services;
WHEREAS the Commission is of the view that a mark-up over costs for AIN interconnection services is warranted and, that in this case, the mark-up is at an acceptable level; and
WHEREAS the Commission is of the view that there are sufficient differences in the interconnection pertaining to public long distance service and the interconnection proposed for AIN that a distinct confidentiality agreement is appropriate -
IT IS HEREBY ORDERED THAT:
Bell Tariff Notice 5890 is approved.
