Telesat Canada (Telesat) Tariff Notice 1125, dated 24 July 1997, requested approval of a Special Assembly Tariff for the provision of one C-band channel on a temporary basis at the Ku-band rate.

1. In support of its application, Telesat submitted that the proposed arrangement would optimize satellite utilization by permitting a Ku-band customer to move to C-band, thereby improving the availability of scarce Ku-band capacity and leasing an additional C-band channel.
2. Comments were received from TMN Networks Inc. in support of the application. ExpressVu Inc. (ExpressVu) did not object to the proposed arrangement unless the customer would be Shaw Communications Inc. or one of its affiliates in which case ExpressVu argued that no decision should be made pending the resolution of the proceeding initiated pursuant to the Broadcasting Act by Public Notice CRTC 1997-94, dated 16 July 1997. Alternatively, ExpressVu submitted that the tariff should prohibit the customer from transferring, directly or indirectly, the Ku-band channel to Star Choice Television Network Incorporated. Canadian Satellite Communications Inc., Canadian Satellite Users Association, and Allarcom Pay Television Limited objected to the proposed arrangement.
3. The objections of parties, among other matters, addressed the possibility of undue preference in providing C-band tariffed service at the lower Ku-band rate, the lack of consideration of the Order Priority List provisions of Telesat's tariff and the possibility that the proposed arrangement could be accomplished through resale of the satellite service at tariffed rates resulting in greater revenue for Telesat and benefiting all of Telesat's customers.
4. The Commission is of the view that serious concerns have been raised regarding Telesat's proposal. Accordingly, on the basis of the record of this proceeding, the Commission denies the Special Assembly Tariff proposed in Tariff Notice 1125.
