Telecom Order

Ottawa, 18 August 1997
Telecom Order CRTC 97-1128
The Commission received a letter dated 27 May 1997 from Hamilton Telecom applying for exemption from contribution charges for Centrex services which are used solely to provide local or single-hop EAS services. Hamilton Telecom also provided an affidavit, dated 24 May 1997, in support of its application.
File No.: 8626-H5-02/97
1. By letter dated 15 July 1997, Bell Canada (Bell) noted that Hamilton Telecom has identified the Centrex system as one in the (905) 765 exchange. In this respect, Bell stated that it reviewed its records and has determined that this system is not yet in service. Accordingly, Bell submitted that the Hamilton Telecom application is best characterized as a request for advance approval of an exemption. In light of the above, Bell agreed that advance approval of a contribution exemption appears to be appropriate. Bell also submitted that final approval should be subject to the receipt of a revised affidavit affirming the actual arrangements when the system is installed.
2. The Commission is of the view that Hamilton Telecom's evidence satisfies its evidentiary requirements for advance approval of the configuration.
3. Based on the foregoing, the Commission orders that Hamilton Telecom's application is approved effective the date of installation, subject to the receipt of a revised affidavit affirming the actual arrangements when the system is installed.
