Telecom Order CRTC 97-1001
The Commission has received an application from The New Brunswick Telephone Company, Limited (NBTel) dated 25 June 1997, for tariff revisions pertaining to the introduction of OC-3 (155 mbps) access and service connection to the company's Digital Broadband Service.

1. In NBTel - Tariff Revisions Relating to Digital Network Access OC-3 and Digital Broadband Services, Telecom Decision CRTC 97-14, 11 June 1997 (Decision 97-14), the Commission denied Tariff Notices 566/A (TN 566/A) identifying in detail a number of concerns, particularly with respect to the costing information provided by the company that raised doubts as to whether the access service was compensatory. Tariff Notices 567/A and 631 were also denied as they were dependent on 566/A. The Commission also indicated that it would be prepared to grant expedited interim approval to an application that adequately addresses those concerns.
2. In Tariff Notice 649 (TN 649), the company has provided information to address the concerns raised in Decision 97-14.
3. The Commission considers that there remain concerns regarding some aspects of the costing of the proposed service.
4. Notwithstanding these concerns, the Commission is satisfied on a prima facie basis that the proposed service is compensatory.
5. The Commission has received comments from Fundy Cable Ltd./Ltée dated 11 July 1997.
6. On the basis of the record to date, the Commission considers that it is appropriate to grant interim approval to the tariff revisions proposed under TN 649. Accordingly TN 649 is granted interim approval.
