Acquisition of assets
1. Following a Public Hearing held in the National Capital Region on 19 August 1997, the Commission approves the application for authority to acquire the assets of the cable distribution undertaking serving Churchill from McTaggart's Cable Ltd., and for a broadcasting licence to continue the operation of this undertaking.
2. Upon surrender of the current licence, the Commission will issue a licence to Dennis and Lynda Zaharia, on behalf of a company to be incorporated to be known as L and D Cable, expiring 31 August 2003, the current expiry date. The operation of this undertaking will be regulated pursuant to Parts I, III and IV of the Cable Television Regulations, 1986. The authority granted herein is subject to the same conditions as those in effect under the current licence, as well as to any other condition specified in the licence to be issued.
3. This authority will only be effective and the licence will only be issued at such time as the Commission receives documentation establishing that an eligible Canadian corporation has been incorporated in accordance with the application in all material respects and that it may be issued a licence.
4. The price of the transaction is $250,000. Based on the evidence filed with the application, the Commission has no concerns with respect to the availability or the adequacy of the required financing and is satisfied with the benefits flowing from this transaction.
