Licence renewal
1. Following Public Notice CRTC 1996-154 dated 13 December 1996, the Commission renews the Class 2 licence held by Filion Câble-Vision inc., for the cable distribution undertaking serving Mont-Tremblant, Saint-Jovite and surrounding area, from 1 September 1997 to 31 August 2004.
2. The operation of this undertaking is regulated pursuant to Parts I, II and IV of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
3. In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, WTVS (PBS) Detroit, Michigan, received via satellite from CANCOM, as part of the basic service.
4. The Commission approves the licensee's application to be relieved, by condition of licence, from the requirement of paragraph 9(1)(a) of the regulations that it distribute CBFT-1 (SRC) Mont-Tremblant, a local service. The licensee will distribute instead CBFT (SRC) Montréal, received via satellite.
5. The Commission also approves the licensee's application to be relieved from the requirement of subsection 10(2) of the regulations that it distribute WTOL-TV (CBS) Toledo, Ohio, as a discretionary service. Accordingly, the licensee is authorized, by condition of licence, to distribute WTOL-TV as part of the basic service of the undertaking.
6. The Commission denies the licensee's application for authority to distribute CHCH-TV Hamilton, Ontario, received via satellite from CANCOM, as part of the basic service. The Commission considers that the distribution of CHCH-TV would not be consistent with the guidelines on the cable distribution of distant Canadian television signals set out in Public Notice CRTC 1993-74. The licensee has not demonstrated that there is no objection on the part of the originating station and that this station would not accept local advertising from the Mont-Tremblant market.
7. The Commission also denies the licensee's application to be relieved from the requirement of subsection 10(2) of the regulations that it distribute TFO, TVOntario's French-language educational television service, received via satellite, as a discretionary service. The licensee proposed to distribute the service as part of the basic service. The Commission notes the intervention filed by TVOntario objecting to the licensee's proposal.
8. It is a condition of licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' "Voluntary Code Regarding Violence in Television Programming", as amended from time to time and approved by the Commission.
9. In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
