|
The Commission will hold a public hearing commencing on 6 May 1996, at 8:30 a.m., at the Conference Centre, Portage IV, 140 Promenade du Portage, Hull, Quebec, to consider the applications which are listed in the body of this notice.
|
|

Background:
|
|
In Public Notice CRTC 1995-205, dated 30 November 1995, the Commission outlined the criteria that it would consider in licensing new specialty and pay television programming undertakings, and in particular, the carriage arrangements outlined previously in Public Notice CRTC 1995-29, relating to the Commission's predisposition in favour of proposals based exclusively on discretionary carriage, either on a stand-alone basis or on a low penetration tier.

|
In its clarification process, the Commission indicated that in order to ensure equitable treatment of all applicants who submitted their proposals by the 11 January deadline, the Commission would not be prepared to accept information which either varied, amended or supplemented the application on file or was in addition to the information requested in the clarification letters.
|
|
Consistent with this approach, the Commission wishes to advise applicants that it will generally not be disposed to accept the filing by applicants of additional information at the 6 May 1996 Public Hearing, other than that which the Commission may deem to be appropriate to request.
|
|
Channel Capacity :
|
|
Applicants and intervenors may wish to note that in Public Notice CRTC 1995-128, dated 28 July 1995, the Commission initiated a public process to consider the development of access rules that will be applicable to the carriage of programming services by all broadcasting distribution undertakings. In view of the importance of having an accurate forecast of cable channel capacity for the hearing and for the consideration of the applicants for new specialty and pay television programming services, in Public Notice CRTC 1995-174, the Commission requested all cable systems serving more than 20,000 subscribers to provide the following information:

- the details of their current channel line-ups.
|
|
- for each exempt programming service carried, the date on which the service was first distributed on the system, as well as the owner/operator of the service.
|
|
- the projected channel capacity of their systems as of 1 September 1996 and 1 September 1997.
|
|
- the proposed time frame for the roll-out of digital video compression technology.
|
|
The Public Hearing to consider these matters was held during the week of 5 February 1996. The information on channel capacity as well as all of the material pertaining to the hearing are available for public examination at any of the Commission's offices.
|
|
At this hearing, there was some discussion of the channel capacity information and how it should be interpreted. It was also noted that a number of cable systems have undertaken changes to their line-ups since the original data was filed. In view of the concerns expressed, the Commission has requested the CCTA to file an update on the available channel capacity by March 31st. This information will also be available for public examination at any of the Commission's offices.

Hearing Process:
|
|
The Commission wishes to remind interested parties that they have the opportunity to provide their complete comments, in writing, concerning the applications listed below, on or before 16 April 1996, which is the deadline for receipt of interventions.
|
|
Interveners requesting to appear at the public hearing will be required to provide reasons as to why their written interventions are not sufficient and an appearance is necessary. The Commission will inform interveners whether their request to appear is granted. All written interventions are considered by the Commission when it makes its decisions.
|
|
Consistent with the Commission's practice in similar proceedings, it will group the appearance of various interveners to particular applications at the same time to ensure the effective use of public hearing time.
|
|
The Public Hearing process will consist of four phases. During Phase 1, representatives for each item on the agenda will make a presentation of their application(s). Representatives for each item published herein, will be permitted a maximum of 20 minutes for presentation at the public hearing.
|
|
Each presentation will be followed by a question period from the Members of the Commission panel. It is expected that nearly 10 days will be required to complete this phase.
|
|
In phase II, the representatives for each item will be permitted a maximum of 10 minutes to present their oral interventions to all other applications. Subsequent to the prescribed deadline for receipt of interventions, applicants may file written interventions of up to 50 pages concerning all other applications, to be received on or before 26 April 1996.
|
|
Phase III will consist of the oral presentations by appearing interveners who will each be permitted a maximum of 10 minutes. As previously stated, the deadline for the submission of written interventions is 16 April 1996.
|
|
In Phase IV, representatives for each item will be permitted a maximum of 10 minutes to reply in the reverse order of appearance to all interventions made to their application. Applicants may also file written replies (providing 20 copies) concerning all interventions to their application and totalling no more than 25 pages, during the public hearing.
|
|
NOTE: 1. The following terms may be used in the outlines of the applications listed below and in the public hearing process to describe the arrangements for cable system distribution proposed by the various applicants. Interested parties should refer to the applications in order to ascertain the details of the distribution arrangements which may expand upon the "generic" descriptions provided below:
|
|
- "discretionary basis" means distribution on either a stand alone basis, or as part of a discretionary package of services, and available to subscribers for a fee separate from and in addition to the basic monthly fee;
|
|
- "dual status basis" means distribution on the basic service or with the consent of the service provider, on a discretionary basis;
|
|
- "modified dual status" means distribution on a discretionary basis, unless the distribution undertaking licensee and the programming service operator agree to its distribution as part of the basic service.
|
|
