IN THE MATTER OF applications by 144937 Canada Inc., doing business as Linton Telephone Answering Service (Linton), and 3124681 Canada Inc., doing business as Western Telecom (Western), for exemption from contribution charges.

WHEREAS Linton filed three affidavits dated 18 March 1996 in support of its application concerning: (a) a Centrex system using six public switched telephone network connections for administrative purposes only; (b) 5 regular telephone lines for answering purposes only; and (c) 12 regular telephone lines, 10 trunk lines, and 500 telephone number access (TNA) numbers for answering purposes only;

WHEREAS by letter dated 2 April 1996, Linton advised that all telephone accounts providing resale had been transferred to Western and that all other accounts are used for calling services;

WHEREAS Western filed a letter and affidavit dated 3 May 1996 requesting an exemption for circuits used to provide single-hop Centrex resale as well as a single business line;
|
WHEREAS by letter dated 13 May 1996, Bell Canada (Bell) submitted that clarification is required of the resale status, for the period prior to the date of the affidavits, of those circuits being retained by Linton;

WHEREAS by letter, Linton provided three new affidavits dated 14 May 1996 in which it swears that its lines are not used and never have been used in the past for reselling purposes;

WHEREAS by letter dated 31 May 1996, Bell stated that Linton's submissions of 14 May 1996 satisfy its request for clarification and that, on the basis of this evidence, the services identified in the 14 May 1996 affidavits should not be subject to contribution charges;

WHEREAS by another letter dated 31 May 1996, Bell agreed with Western's application; and
|
WHEREAS the Commission is of the view that Linton and Western have satisfied the evidentiary requirements set out in Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993 -

1. Linton's application for exemption for its call answering system is approved for the entire period those services have been in use.
|
2. Western's application for exemption is approved: (a) effective the date of Linton's original application (18 March 1996) for its single-hop Centrex system; and (b) effective the date of installation for the business line.
