Telecom Order CRTC 96-64
IN THE MATTER OF an application by Bell Advanced Communications Inc. (BAC Inc.) dated 5 September 1995, for an exemption from contribution charges for cross-border circuits leased from Bell Canada (Bell) and BC TEL to provide data services.
 WHEREAS BAC Inc. submitted an affidavit which stated that the circuits in question are used to provide data-only services and that it does not provide voice service to its customers;
 WHEREAS Stentor Resource Centre Inc. submitted a letter dated 14 September 1995 on behalf of Bell and BC TEL stating that it agreed that the application and affidavit provided by BAC Inc. satisfy the evidence set out in Applications for Contribution Exemptions, Telecom Decision CRTC 93-2 (Decision 93-2) for data-only providers;
 WHEREAS the Commission notes that BAC Inc. is an affiliate of Bell and, pursuant to Resale and Sharing of Private Line Service, Telecom Decision CRTC 90-3, 1 March 1990, is not prohibited from reselling data services; and
 WHEREAS the Commission considers that the application meets the evidentiary requirements as set out in Decision 93-2 -
 IT IS HEREBY ORDERED THAT:
 BAC Inc.'s application for an exemption from contribution charges is approved.
