Telecom Order CRTC 96-595
IN THE MATTER OF an application by Bell Canada (Bell) under Tariff Notice 5665 dated 21 December 1995 (TN 5665), as modified by Tariff Notice 5665A dated 1 March 1996 (TN 5665A), proposing tariff revisions to be implemented in two phases to restructure the rates for business local exchange services.
WHEREAS on 17 April 1996, the Commission issued Bell Canada - Restructuring of Rates for Business Local Exchange Services - TelecomLink, Telecom Public Notice CRTC 96-13 (PN 96-13) with respect to TN 5665;
WHEREAS in a letter dated 15 May 1996, Bell requested interim approval of Phase I of its proposed rate restructure of business primary exchange service by 31 May 1996 in order to allow adequate time for a 1 July 1996 effective date;
WHEREAS by letter dated 17 May 1996, the Commission requested comments on Bell's request;
WHEREAS comments were received from many parties including: Canadian Cable Television Association, Canadian Federation of Independent Business, Interactive Services Association and Rogers Network Services;
WHEREAS Bell filed reply comments on 28 May 1996;
WHEREAS the interveners opposed Bell's request, arguing, among other things, that interim approval of Phase I of the tariff changes in TN 5665 would interfere with the process established in PN 96-13;
WHEREAS the Commission considers that interim approval of Phase I would not affect the Commission's determination with respect to Phase II nor would it prejudice the Commission's final determination with respect to Phase I, based on the complete record of the proceeding;
WHEREAS the Commission notes Bell's submission that Phase I is a continuation of the process of compressing business rates within the existing rate group structure that was initiated by Bell in Tariff Notice 5020 and subsequently approved in Telecom Order CRTC 94-400 dated 21 April 1994;
WHEREAS the Commission notes Bell's submission that interim approval of Phase I would partially offset the current inequity between Bell's business individual line and PBX trunk subscribers; and
WHEREAS the Commission notes that the proposed Phase I tariff changes are designed to be revenue neutral -
IT IS HEREBY ORDERED THAT:
Phase 1 of TN 5665 is granted interim approval with an effective date of 1 August 1996.
