Telecom Order CRTC 96-39
IN THE MATTER OF an application by Vancouver Telephone Company Limited (VTC) dated 22 March 1995 requesting exemption from contribution charges for ten circuit configurations.
 WHEREAS, on 14 June 1995, VTC filed schematic diagrams of the configurations in question;
 WHEREAS, on 19 June 1995, BC TEL filed comments;
 WHEREAS, on 23 June 1995, VTC filed reply comments and sought interim approval of two operating configurations (4 and 5) and advance approval of the remaining eight proposed configurations;
 WHEREAS, the Commission notes that certain of the configurations proposed by VTC would allow for the routing of Canada-Canada and Canada-overseas traffic via other than Canadian facilities, contrary to Teleglobe Canada Inc. - Resale of Transborder Services, Telecom Decision CRTC 91-10, 26 June 1991; and
 WHEREAS, consistent with the Commission's determinations in Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993, certain configurations would require further evidence including technical audits or carrier verification -
 IT IS ORDERED THAT:
 The individual configurations that are the subject of this Order are determined in accordance with the rulings set out for each such configuration in the Appendix.

APPENDIX
CONFIGURATION 
Dedicated facilities originating on a reseller's switch in the U.S. and terminating on VTC's Centrex switch in Canada that will carry international transit traffic. 
Identical to configuration 1 except for the ability to overflow traffic via Equal Ease of Access connections with contribution payable by the receiving carrier or reseller. 
Dedicated facilities originating on a reseller's switch in the U.S. and terminating on switching facilities in Canada that carry international transit traffic. 
Dedicated facilities originating on the applicant's Centrex switch and terminating on dedicated switching facilities in Canada. 
Dedicated facilities originating on BC TEL's Centrex switch and terminating on a dedicated reseller's switching facilities in the U.S. that will carry cross-border traffic originated from the applicant's Centrex service and terminated on dedicated Centrex lines. 
  Advance approval, subject to receipt of a technical audit confirming that the voice and data traffic are carried on physically-separate networks or that equipment such as VDDs have been attached to its network to preclude voice usage.
